Terms of Service

Effective Date: 15 May 2025

1. Agreement to Terms

These Terms of Service ("Terms") constitute a binding agreement between you ("Client", "you") and Abakhisa Group (Pty) Ltd T/A Abakhisa Nova ("Abakhisa", "we", "our", or "us"). By accessing or using our services, website, customer portal, or by entering into a Nova Plan subscription, you agree to be bound by these Terms.

2. Service Description

We provide fire protection and safety services, including equipment servicing, signage compliance, risk assessments, training, and more under our Nova Core, Shield, Elite, and Ultimate plans.

3. Eligibility & Access

Services are intended for legal South African entities. Portal access is restricted to verified clients and internal staff only.

4. Client Responsibilities

Provide accurate contact and site information.
Allow site access for scheduled service visits.
Update your details when necessary.
Do not tamper with or misuse our systems.

5. Payment Terms

Payments are due per your chosen plan schedule (monthly/quarterly/annually). Late payments incur a 10% monthly penalty. Accepted methods include EFT, card, and government POs.

6. Cancellations & Refunds

Plans can be cancelled with 30 days’ notice. Refunds are not offered on prepaid amounts unless required by law or due to a fault in our delivery.

7. Compliance & Certifications

We comply with SANS 1475, SANS 1186, and SAQCC Fire. Certificates of Compliance (COCs) are issued after service delivery and compliance verification.

8. Limitation of Liability

We are not liable for fire incidents outside of our service scope, or where recommendations are ignored. Liability is capped to the value of the disputed service fee.

9. Intellectual Property

All portal content, reports, and brand assets remain our property and may not be reused without written permission.

10. Privacy

Your data is handled according to our Privacy Policy and POPIA. Requests for access or deletion can be made via privacy@abnova.co.za.

11. Force Majeure

We are not liable for delays due to strikes, weather, or events beyond our control.

12. Governing Law

This agreement is governed by the laws of South Africa.

13. Amendments

We may update these Terms and will notify users via portal or email. Continued use implies acceptance.
